You Cannot Return to Work Without This Step
Under 49 CFR Part 40, any DOT-regulated employee who violates drug or alcohol policy must complete a mandatory evaluation with a qualified qualified SAP Evaluator before they are eligible to return to a safety-sensitive position.
This is not optional. Your employer cannot reinstate you, and you cannot take a return-to-duty test, until a SAP has evaluated you, issued a treatment recommendation, and completed a follow-up evaluation confirming you've complied.

What Triggers a Required SAP Evaluation?
- Positive DOT drug test (marijuana, cocaine, opioids, amphetamines, PCP)
- Breath alcohol test result of 0.04 or higher
- Refusal to submit to a DOT-required test
- Alcohol use on the job or within 4 hours before duty
- Any other violation of 49 CFR Part 40 drug & alcohol rules
